What N.M. Stat. §47-8-15(D) requires
- Maximum fee: 5% of the rent for the period (lowered from 10% in 2025)
- Grace period: None — the lease sets it
- Lease requirement: the fee must be authorized in the written rental agreement — an unauthorized fee is uncollectible.
- The cap dropped from 10% to 5% effective June 20, 2025 — leases written under the old ceiling need updating
- To collect, the landlord must give written notice of the fee no later than the end of the next rental period after the default

Did New Mexico's late fee limit change?
Yes. A 2025 amendment to §47-8-15(D) cut the maximum from 10% to 5% of the rent for the period, effective June 20, 2025. A lease clause written at 10% is now enforceable only to 5% — and the landlord still has to notice the fee by the end of the following rental period to collect it.
