What W. Va. Code §§37-6A-1(7), 37-6A-2 requires
- Return deadline: 45–60 days
- 60 days — After termination of tenancy
- 45 days — After a new tenant occupies the unit, if sooner. Whichever period is shorter applies
- Deposit cap: No statewide cap
- Itemized deduction notice required within the applicable period
- Period extends 15 days when damage exceeds the deposit and a contractor is engaged (with written notice)
- Wrongful withholding: liable for up to 1.5x the amount due in addition to the amount withheld
