What W. Va. Code §§37-6A-1(7), 37-6A-2 requires

  • Return deadline: 45–60 days
    • 60 days After termination of tenancy
    • 45 days After a new tenant occupies the unit, if sooner. Whichever period is shorter applies
  • Deposit cap: No statewide cap
  • Itemized deduction notice required within the applicable period
  • Period extends 15 days when damage exceeds the deposit and a contractor is engaged (with written notice)
  • Wrongful withholding: liable for up to 1.5x the amount due in addition to the amount withheld
