What Tex. Prop. Code §§92.103–92.109 requires
- Return deadline: 30 days
- Deposit cap: No statewide cap
- Clock effectively starts when the tenant surrenders and provides a forwarding address
- Written itemized deduction list required (unless tenant owes rent with no dispute)
- Bad-faith retention: $100 plus 3x the amount wrongfully withheld plus attorneys' fees; advance-notice-of-surrender conditions must be conspicuous in the lease
