What Tex. Prop. Code §§92.103–92.109 requires

  • Return deadline: 30 days
  • Deposit cap: No statewide cap
  • Clock effectively starts when the tenant surrenders and provides a forwarding address
  • Written itemized deduction list required (unless tenant owes rent with no dispute)
  • Bad-faith retention: $100 plus 3x the amount wrongfully withheld plus attorneys' fees; advance-notice-of-surrender conditions must be conspicuous in the lease
