What 765 Ill. Comp. Stat. 710/1 requires
- Return deadline: 30–45 days
- 30 days — Itemized damage statement when withholding (5+ unit properties). Receipts due within 30 days after an estimated statement
- 45 days — Full refund when no timely itemized statement is furnished
- Deposit cap: No statewide cap
- State act applies to landlords with 5 or more units; Chicago's RLTO imposes stricter local rules
- Interest owed on deposits held 6+ months in buildings of 25+ units (765 ILCS 715)
- Bad-faith withholding: 2x the deposit plus damages, costs, and attorneys' fees
