What 765 Ill. Comp. Stat. 710/1 requires

  • Return deadline: 30–45 days
    • 30 days Itemized damage statement when withholding (5+ unit properties). Receipts due within 30 days after an estimated statement
    • 45 days Full refund when no timely itemized statement is furnished
  • Deposit cap: No statewide cap
  • State act applies to landlords with 5 or more units; Chicago's RLTO imposes stricter local rules
  • Interest owed on deposits held 6+ months in buildings of 25+ units (765 ILCS 715)
  • Bad-faith withholding: 2x the deposit plus damages, costs, and attorneys' fees
