What Wis. Admin. Code ATCP 134 requires
- Maximum fee: No statutory cap — but strict disclosure rules
- Grace period: None — the lease sets it
- Lease requirement: the fee must be authorized in the written rental agreement — an unauthorized fee is uncollectible.
- No cap, but Wisconsin's consumer-protection code (ATCP 134) requires the fee to be in the written agreement and bars charging a late fee on an unpaid late fee
- ATCP violations can support double damages plus attorney's fees under Wis. Stat. §100.20(5) — get the lease language right
Rules as of August 2026. Statutes change — verify with the current text of Wis. Admin. Code ATCP 134 before relying on a number, and check city and county ordinances, which can be stricter. This is general information, not legal advice; consult a Wisconsin attorney for your situation.
