What Ariz. Rev. Stat. §33-1368(B) requires

  • Maximum fee: No statutory cap — reasonable, and in a written lease
  • Grace period: None — the lease sets it
  • Lease requirement: the fee must be authorized in the written rental agreement — an unauthorized fee is uncollectible.
  • The fee must be set out in a WRITTEN rental agreement — an oral lease supports no late fee at all
  • No fixed cap and no statutory grace period for ordinary rentals; courts treat 5–10% of monthly rent as the reasonable range
  • The $5-per-day cap many sites quote is the mobile-home-park rule (§33-1414) — it has never applied to houses or apartments
  • The 5-day notice in the same statute is the eviction cure window for nonpayment, not a late-fee grace period

Is there a $5-per-day late fee limit in Arizona?

Not for houses or apartments. The $5-per-day cap comes from Arizona's mobile-home-park statute (A.R.S. §33-1414) and applies only to mobile-home spaces. For ordinary rentals, A.R.S. §33-1368(B) requires the fee to be reasonable and written into the rental agreement — no fixed dollar cap.

Does Arizona require a grace period before charging a late fee?

No. State law sets no grace period for standard rentals — the lease controls when rent is late and when the fee applies. The 5-day notice landlords must serve before an eviction for nonpayment is a separate cure period, not a late-fee grace period.
